Terms of Use
The short version
- You buy CueSpot from Apple. Apple takes the payment and handles refunds.
- Your scripts and your recordings are yours. We claim nothing in them and cannot reach them.
- The weekly subscription renews until you cancel it, in your Apple Account settings.
- Back up recordings that matter to you. They live on your device, and devices break.
This box is a summary for orientation. The sections below are what actually applies.
1. Who you are dealing with
CueSpot is developed and published by Finn Eming, Am Huchtert 26, 58456 Witten, Germany, cuespot@proton.me (“we”, “us”). The full provider details are in the imprint.
The app is distributed exclusively through Apple's App Store. Apple is the merchant of record for every download and every purchase. Your contract for the transaction itself is with Apple; these terms govern your use of the app.
2. Licence
CueSpot is licensed, not sold. Apple's Licensed Application End User License Agreement (the “Standard EULA”) applies and grants you a personal, non-transferable licence to use CueSpot on Apple-branded devices you own or control, under the Usage Rules in Apple's Media Services Terms and Conditions.
These Terms of Use supplement the Standard EULA. If a provision here conflicts with the Standard EULA on the scope of the licence, the Standard EULA prevails. Everything else here applies alongside it.
3. What you need
CueSpot requires an iPhone with a Dynamic Island and iOS 26 or later, because the prompter is drawn into the Dynamic Island region. It needs the camera, the microphone and permission to save to Photos in order to record. We do not promise that the app will run on hardware or operating system versions outside those requirements, including future ones.
4. Free features and CueSpot Pro
Part of CueSpot is free to use. CueSpot Pro unlocks the rest and is offered in two forms:
- A weekly subscription with a free trial period of seven days. Unless you cancel, the subscription renews automatically at the end of each period and your Apple Account is charged for the next one.
- A one-time lifetime purchase, which unlocks the Pro features permanently for the Apple Account that bought it, with no recurring charge.
Current prices are shown in the app and in the App Store before you confirm, in your local currency, and the App Store listing is the binding one. Prices may change for future periods; Apple notifies subscribers of price increases and asks for consent where it is required.
Renewal and cancellation
Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Any unused part of a free trial is forfeited when you buy a subscription.
You can view, manage and cancel a subscription at any time under Settings → your name → Subscriptions on your iPhone. Cancelling stops the next renewal; Pro remains active until the end of the period you have already paid for. Deleting the app does not cancel a subscription.
Refunds and right of withdrawal
Because Apple is the merchant of record, refunds and statutory withdrawal requests are handled by Apple, not by us. Use reportaproblem.apple.com or contact Apple Support. As a consumer in the EU, your statutory rights apply in the form set out in Apple's Media Services Terms and Conditions, which is the agreement you enter into at the moment of purchase. Write to us if Apple's process does not resolve the problem and we will help where we can.
5. Your scripts and your recordings
Everything you write, import or record stays yours. We claim no ownership, no licence and no right to use it. As set out in the privacy policy, your content never leaves your device, so we have no technical ability to read, copy, moderate or recover it — including if you ask us to.
That cuts both ways: you are responsible for your own backups. Recordings you confirm are saved to your Photos library and are covered by whatever backup you have for Photos. Scripts and presets live in the app and are included only in an encrypted device or iCloud backup. If you delete the app, lose the device, or discard a take, that material is gone, and we cannot restore it.
You are also responsible for what you record — that you have the right to use the text you read, and the consent of anyone else who appears in the picture or on the audio.
6. How you may use CueSpot
You agree not to:
- use CueSpot to produce or distribute content that is unlawful where you are;
- circumvent, disable or interfere with the purchase and entitlement checks;
- decompile, disassemble or reverse engineer the app, except to the extent that mandatory law expressly permits it (in Germany, § 69d and § 69e UrhG);
- redistribute, rent, sub-licence or resell the app or any part of it.
7. Availability and changes to the app
CueSpot runs on your device and does not depend on a server we operate, so there is little for us to take offline. We may still change, add or remove features in future versions, for example to follow changes in iOS or in Apple's requirements. Where a change materially reduces a Pro feature you have paid for, we will say so in the release notes, and your statutory rights are unaffected.
Features that depend on third parties — the App Store, Apple's purchase infrastructure, the purchase verification described in the privacy policy — can be unavailable for reasons outside our control.
8. Warranty
Statutory warranty rights for digital products under German law apply and are not restricted by these terms. Because Apple is the merchant of record, claims are handled through Apple in the first instance; Apple's Standard EULA sets out how, and Apple's maximum liability for a warranty failure is a refund of the purchase price.
We do not warrant that CueSpot is free of every defect or that it will suit a particular purpose of yours. It is a tool for reading a script at a camera; whether the result is a good take is not something software can promise.
9. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent we have given a guarantee.
For slight negligence we are liable only where a material contractual obligation has been breached — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical of this kind of contract.
Any further liability is excluded. This applies in particular to lost recordings and lost scripts, since the app stores them only on your device and backing them up is in your hands, as described in section 5.
10. Term and termination
The licence runs for as long as you use the app. You end it by deleting CueSpot from your devices, and separately by cancelling any subscription in your Apple Account. We may terminate the licence if you materially breach these terms, in particular section 6. Sections 5, 8, 9 and 11 survive termination.
11. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another country, this choice of law does not deprive you of the protection of the mandatory provisions of the law of that country.
There is no agreed place of jurisdiction for consumers; the statutory rules apply. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered place of business.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
12. Changes to these terms
We may update these terms, for example when the app changes or the law does. The version and date at the top always show the current one. Changes that materially affect an active subscription will be announced in the app before they take effect, and you may cancel if you do not accept them.
